• Several measures were approved by Senate committees Monday.

-SB 1694 by Sen. Sean Burrage, directs the State Department of Education to encourage school boards and districts to develop mentorship programs aimed at reducing drop-out rates.

-SB 1182 by Sen. David Myers, prohibits children under the age of 18 from being permitted in a designated smoking room.

-SB 1515 by Sen. Debbe Leftwich, expands the powers of the Construction Industries Board to include establishing and maintaining a list of verified citations made within the last five years against contractors in the trades and industries regulated by the board.

-SB 1457 by Sen. Nancy Riley, authorizes municipalities to limit the number of requests it will consider for proof of compliance from a mining operator.

-SB 1570 by Sen. Brian Bingman, allows counties to have audits performed by certified public accountants.

-SB 1168 by Sen. Owen Laughlin, modifies language related to the liability for costs of medical care to defendants in the custody of a county jail.

-SB 1144 by Sen. John Sparks, increases from $600 to $1,000 the maximum monthly travel allowance for county commissioners and sheriffs for travel within their counties and increases monthly travel allowances for county assessors and clerks.

-SB 1507 by Sen. Jay Paul Gumm, requires reports, administrative rules, budget work programs and requests and any other document to be filed with the governor and leaders of the legislature to be filed electronically.

-SB 1399 by Sen. Joe Sweeden, would direct county purchasing agents to attend training seminars sponsored by the Oklahoma Cooperative Extension Service.

-SB 1859 by Sen. Charles Wyrick, creates the Oklahoma Dairy Promotion Act and the Oklahoma Dairy Promotion Commission.

-SB 1582 by Sen. Ron Justice, increases from $500 to $5,000 the amount of contract that county fair boards must present to boards of county commissioners for review.

-SB 1735 by Sen. John Sparks, specifies a second-offense punishment for persons who fish on land without consent and makes all offenders responsible for damages they cause.

-SB 1669 by Sen. Glenn Coffee, adds federally recognized Indian tribes to the list of charter school sponsors.

-SB 1186 by Sen. Mary Easley, increases the amount of physical education or exercise required for public elementary school students from 60 minutes to 120 minutes each week.

-SB 1442 by Sen. Roger Ballenger, designates the Oklahoma State University campus located in Okmulgee the Oklahoma State University Institute of Technology at Okmulgee.

-SB 1503 by Sen. David Myers, directs the State Department of Education to notify school districts of any changes to the Oklahoma Cost Accounting System reporting codes that will be in effect for the following fiscal year. The measure also limits state Department of Education changes to certain codes and procedures to no more than once per year.

-SB 1585 by Sen. Clark Jolley, removes language related to the issuance of audited financial statements of the Oklahoma Higher Education Promise of Excellence Act of 2005.

-SB 1634 by Sen. Kathleen Wilcoxson, declares the high school graduation rate shall be 100 percent by the 2013-14 school year. The bill would also require the state Department of Education to begin using the National Governors Association graduation compact formula rather than the federal No Child Left Behind formula.

-SB 1686 by Sen. Mary Easley, directs that professional development programs for teachers include a special emphasis on autism.

-SB 1880 by Sen. Clark Jolley, extends the lifespan of the Achieving Classroom Excellence II Task Force and extends the terms of appointed members.

-SB 1453 by Sen. Roger Ballenger, adds metal beer kegs that are clearly marked as being the property of the beer manufacturer to the list of items junk dealers are prohibited from purchasing without proof that the seller owns the item.

-SB 1529 by Sen. Debbe Leftwich, modifies the definition of “practice of engineering” as it relates to registration of engineers and land surveyors.

-SB 1550 by Sen. Charles Laster, requires payors as well as employees doing business in the state to make reports to the Oklahoma Employment Security Commission new hire registry.

-SB 1608 by Sen. Jay Paul Gumm, modifies language related to the definition of “current net price” for certain vehicle contracts.


• The House convened Monday and approved numerous appropriations shell bills before resuming committee activity.

• House committees on Monday approved the following measures:


-HB 2547 by Rep. Phil Richardson, increases from $250 to $500 the minimum fine for trespassing on a private farm, ranch or forestry land.

-HB 2774 by Rep. Dale DeWitt, repeals language relating to permits for the use of water for swine animal feeding operations.

-HB 2218 by Rep. Jerry Shoemake, creates the Oklahoma Livestock Development Act of 2008.

-HB 2641 by Rep. Ron Peters, directs the State Board of Health to consult with the Home Health Advisory Board to establish rules for the Home Care Act.

-HB 2628 by Rep. George Faught, prohibits school districts from permitting a nongovernmental entity, organization or agency that promotes abortions, provides abortion services or provides information about abortion services from being involved in teaching a sex education class or program.

-HB 3122 by Rep. Tad Jones, requires a school year to consist of at least 1,080 hours.

-HB 2574 by Rep. Jeff Hickman, modifies physical education requirements.

-HB 2544 by Rep. Phil Richardson, modifies language relating to the Wildlife Conservation Commission.

-HB 3100 by Rep. Gary Banz, directs that the Oklahoma Legislative Medal of Honor be awarded to a member of the state or federal military forces who voluntarily performs a deed of personal bravery or self sacrifice involving risk of life and establishes a qualifying criteria.

-HB 2582 by Rep. Terry Hyman, directs Murray State College to offer low division courses and programs.

-HB 2446 by Rep. David Braddock, makes the financial need provision for participation in the Oklahoma Higher Learning Access Program not applicable to any student adopted while in the permanent custody of DHS.

-HB 3120 by Rep. Tad Jones, increases from 25 percent to 30 percent the maximum limitation on awards, funding on awards or funding for the Oklahoma State Regents Academic Scholars program that may go to nonresident students.

-HB 3059 by Rep. Rebecca Hamilton and Rep. Lisa Billy, mandates conspicuous signage at locations that provide abortions listing information about a person’s right to seek protection from actual or threatened abuse or violence and describing the unlawfulness of performing an abortion against one’s will.

• With attention focused on getting measures assigned and heard by committees by the February 22 deadline, the Senate met briefly on Tuesday, approving the following measure:

-HB 1711 by Sen. Jim Wilson, permits unemancipated persons under 18 who are in the permanent custody of the Department of Human Services to be excluded from submitting an application for restricted license signed by another person if the applicant can provide proof of financial responsibility.


Numerous measures were approved by Senate committees on Tuesday including:

-SB 1412 by Sen. Randy Brogdon, restricts access to computerized finger imaging obtained for the issuance of commercial drivers licenses to the Department of Public Safety.

-SB 1413 by Sen. Randy Brogdon, makes computerized finger imaging for obtaining a drivers license or identification card an option rather than a requirement.

-SB 1178 by Sen. Bill Brown, modifies language relating to the Oklahoma Vessel and Motor Registration Act.

-SB 1725 by Sen. Mike Shulz, clarifies language related to the civil rights of individuals sentenced to confinement in a Department of Corrections facility.

-SB 1644 by Sen. Jeff Rabon, adds emergency maintenance to the purposes for which money in the County Improvements for Road and Bridges Fund may be used by the Transportation Commission.

-SB 1181 by Sen. Jeff Rabon, modifies the definition of “design consultant” as it relates to projects under the Department of Transportation and the Oklahoma Transportation Authority.

-SB 1580 by Sen. Cliff Branan, modifies the definition of “primary highway” under the Highway Advertising Control Act.

-SB 1651 by Sen. Joe Sweeden, authorizes the Oklahoma Turnpike Authority to construct, maintain, repair and operate a new turnpike or parts of a new turnpike in Tulsa.

-SB 1148 by Sen. Patrick Anderson, authorizes the use of a simplified return or affidavit in lieu of an estate tax return when the net estate of a decedent passes to a father, mother, child or other lineal descendent.

-SB 1145 by Sen. Patrick Anderson, increases from 10 to 30 days the notice that must be given by excavators prior to the commencement of an excavation or demolition.

-SB 1673 by Sen. Don Barrington, authorizes state agencies to request national criminal history records checks on all persons authorized to access or review national criminal history records checks information.

-SB 1647 by Sen. Richard Lerblance, decreases the maximum fee from $300 per month to $15 per day for electronic monitoring of defendants convicted of a crime.

-SB 811 by Sen. Charles Laster, provides inmates in pretrial detention or custody of a county jail the opportunity to receive necessary medical care for a preexisting condition, the cost of which is the responsibility of the inmate.

-SB 1830 by Sen. Richard Lerblance, amends, merges, consolidates and repeals duplicate sections of law.


• Senate committees passed numerous bills on Wednesday:

-SB 1599 by Sen. Debbe Leftwich, directs the Department of Public Safety to extend the period of suspension, revocation or denial of driving privileges for an additional 12 months upon receiving a record of conviction for driving while under suspension or revocation.

-SB 1551 by Sen. Richard Lerblance, modifies language relating to the Elevator Safety Act, requiring annual inspection of all elevator units and altering fees under the act.

-SB 1630 by Sen. John Ford, exempts from the Oklahoma Central Purchasing Act production and mailing of revenue-generating materials necessary to the ongoing operation of Oklahoma Today Magazine.

-SB 1190 by Sen. Charles Wyrick, modifies language related to the Lead-Impacted Communities Relocation Assistance Act.

-SB 1745 by Sen. Randy Bass, makes it a misdemeanor for anyone to purchase, access, compile or maintain electronically accessible driver’s license information.

-SB 1416 by Sen. Susan Paddack, establishes penalties for persons who violate gross vehicle weight limits.

-HB 3159 by Rep. Gus Blackwell, modifies language relating to the Department of Corrections’ risk assessment review committee and the sex offender screening tool.

-HB 3052 by Rep. Jeff Hickman, modifies language related to court fees, reducing the fine for exceeding the speed limit by 1 to 10 miles per hour to $27 and establishing a $48 fee for violating the Oklahoma Mandatory Seat Belt Use Act or exceeding the speed limit by 11 to 15 miles per hour.

-HJR 1081 by Rep. Gus Blackwell, proposes a constitutional amendment to abolish the Alcoholic Beverage Laws Enforcement Commission and to split the duties of the Commission between the Oklahoma Tax Commission and the Oklahoma State Bureau of Narcotics and Dangerous Drugs Control.

-HCR 1047 by Rep. Joe Dorman, directs the Oklahoma Historical Society to host a website at www.oklahomarocksong.org and have polling locations at special events and at the center, allowing people to nominate songs to be selected as the state’s official rock and roll song.

-HB 3126 by Rep. John Enns, creates the Advancement in Stem Cell Cures and Therapies Act, allowing stem cell research to be conducted in the state if it is performed ethically and safely and without the use of a human embryo.

• House Speaker Chris Benge filed House Resolution 1051, which seeks to form a committee to examine allegations against State Auditor and Inspector Jeff McMahan. The formation of the committee could lead to impeachment proceedings within the coming weeks.

• The Department of Human Services on Thursday was accused in a federal lawsuit of subjecting children in state custody to abuse and neglect. The lawsuit was filed by a New York child advocacy group in conjunction with numerous Oklahoma firms and an international law firm.

• Figures released this week by a national foreclosure information service show foreclosure rates in Oklahoma to be significantly lower than those of the nation as a whole. The service suggested low unemployment rates and increasing home equity have kept Oklahoma largely immune to the national trend.

• The Senate on Tuesday honored 2007 Jim Thorpe Award winner Antoine Cason of the University of Arizona. The Senate unanimously approved Senate Resolution 53, recognizing and commending the standout cornerback. As a senior, Cason was named first-team All American by the Walter Camp Football Foundation and the Football Writers Association of America and was selected first-team all PAC-10 Conference. Cason finished his Arizona career with 15 interceptions.
