-SB 1840 by Sen. Anthony Sykes, creates a task force to study the availability of retail natural gas service in Southwestern Oklahoma.

-SB 2113 by Sen. Patrick Anderson, amends, merges, consolidates and repeals duplicate sections of the law.

-SB 1354 by Sen. Jerry Ellis, changes the maximum age of a commissioned officer position for the Oklahoma Highway Patrol Division from 43 to 45.

-SB 1898 by Sen. Brian Bingman, eliminates the Grand River Dam Authority as being exempt from the Oklahoma Surplus Act.

• Senate committees approved the following measures on Monday:

-SB 2330 by Sen. John Ford, creates the Empowered Schools and School Districts Act and allows a school or district to submit to its district school board an empowerment plan.

-SB 1384 by Sen. Andrew Rice, requires the Oklahoma Tax Commission, Oklahoma Workers’ Compensation Court and Oklahoma Employment Security Commission to share information and coordinate efforts to detect employers who intentionally misclassify individuals as independent contractors rather than employees to affect procedures and payments relating to withholdings and Social Security, unemployment tax or workers’ compensation premiums.

-SB 1937 by Sen. Harry Coates, creates the Oklahoma Employees Classification Act.

-SB 1385 by Sen. Jim Wilson, requires the Oklahoma Employment Security Commission to create the Shared Work Unemployment Compensation Program.

-SB 1592 by Sen. Mike Schulz, allows the release of certain information obtained by the Oklahoma Employment Security Commission to be disclosed to the Center of International Trade at Southwestern Oklahoma State University.

Harry Coates, requires minimum wage notices advertised for sale by individuals, partnerships, associations, corporation, business trusts, limited liability companies or other business entities to include a notice that such notices are available from the Department of Labor at no cost.

-SB 1628 by Sen. Harry Coates, repeals statutory language regarding the Commissioner of Labor approving a list of the most hazardous industries in the state.

-SB 1686 by Sen. Harry Coates, makes mechanics and materialmen’s liens affecting property occupied as a dwelling by its owner invalid unless a pre-lien notice was sent within 90 days of the last furnishing of materials, services, labor or equipment by the claimant.

-SB 1698 by Sen. Harry Coates, repeals numerous sections of the Oklahoman Minimum Wages on Public Works Act.

-SB 1871 by Sen. Harry Coates, requires that the owner of property or the owner’s agent who attempts to determine cost estimates or a list of materials based upon a drawing or plan for a construction project not be held liable for the acts of or deemed to practice a profession or trade required to be licensed.

-SB 2027 by Sen. Clark Jolley, exempts brewers of less than 300,000 gallons of beer per calendar year from certain requirements.

-SB 2070 by Sen. Harry Coates, amends the requirements that those applying to take the tests or examinations for certain professional licenses from not having been convicted of a felony to not having been convicted of a crime that substantially relates to the profession for which the individual is seeking licensure.

-SB 2086 by Sen. Bryce Marlatt, allows students who have attended a foreign school to come to Oklahoma under the PAVE Program for Clinical Skill Evaluation.

-SB 2182 by Sen. Brian Bingman, allows individuals holding a journeyman or contractor license under the Electrical License Act and the Mechanical Licensing Act to pay a reduced renewal fee of 25 percent of the license’s renewal cost upon showing that they are physically injured and will be unable to work during the subsequent license year.

-SB 2099 by Sen. Randy Brogdon, redirects the deposit of certain payments from the state treasury to the Oklahoma Uniform Building Code Commission Revolving Fund.

-SB 2210 by Sen. Cliff Branan, prohibits the spouse of a package store license holder from holding another license provided for pursuant to the Oklahoma Alcoholic Beverage Control Act.

-SB 1766 by Sen. Mike Schulz, authorizes counties to issue permits designed to regulate the movement of oversized and overweight vehicles upon highways subject to their jurisdiction.

-SB 1656 by Sen. Joe Sweeden, clarifies language related to the Oklahoma Municipal Code.

-SB 2092 by Sen. John Sparks, expands the purpose of the County Budget Act to include fostering cooperation among elected officials for effective and informed operation of county government.

-SB 1303 by Sen. Harry Coates, modifies language related to the Public Competitive Bidding Act, increasing from $2,500 to $5,000 the maximum threshold of public construction contracts for minor maintenance or repair that may be negotiated with a qualified contractor.

-SB 1863 by Sen. Brian Bingman, adds language requiring municipalities with websites to publish every municipal ordinance on the site.

-SB 1957 by Sen. Anthony Sykes, requires that each sub-state planning district that has a rural fire coordinator program will employ a rural fire coordinator and establishes the duties of the coordinator.

-SB 1833 by Sen. Anthony Sykes, exempts students in the seventh through 12th grades that show animals at livestock shows from providing verification of a Federal Premise Identification Number.

-SB 1857 by Sen. Harry Coates, grants the State Board of Agriculture the powers and duties to maintain traceability of state standards to the National Institute of Standards and Technology and adopt standard weights and measures for products, conduct investigations to ensure compliance, inspect packaged commodities offered for sale to determine whether they contain the amounts represented and enforce standard weights and measures.

-SB 1859 by Sen. John Ford, removes language relating to how a pretermination hearing of a teacher recommended for dismissal or non-reemployment should be held.

-HB 2297 by Rep. Rex Duncan, modifies penalties for knowingly and willfully permitting an individual under age 21 who is an invitee to the person’s residence, building or structure to possess or consume alcoholic beverages.

-HB 2654 by Rep. Daniel Sullivan, allows sheriffs, deputy sheriffs and reserve deputy sheriffs to enforce ordinances within a municipality under a mutual aid agreement entered into under the Interlocal Cooperation Act.

-HB 2733 by Rep. Wade Rousselot, allows county courts to grant a qualified relative custody in certain cases in which a minor or minors have been abandoned.

-HB 2631 by Rep. Dennis Johnson, requires part-time reserve peace officers certified by the Council on Law Enforcement Education and Training to complete a minimum of eight hours of continuing law enforcement training.

-HB 2306 by Rep. Jason Murphey, expands the powers and duties of the board of directors of rural road improvement districts to include establishing rules and regulations for the construction and maintenance of culverts and drainage projects.

-HB 2791 by Rep. Steve Kouplen, modifies the definition of “eligible agricultural business” under the Oklahoma Agricultural Linked Deposit Program.

-HB 2593 by Rep. Dan Kirby, authorizes the Board of Dentistry to inspect any dental laboratory prior to the issuance of any permit.

-HB 2751 by Rep. Lee Denney, requires any alien unlawfully present under federal immigration law and any individual accused of murder or rape to submit to DNA testing upon arrest.

-HB 2846 by Rep. Charles Joyner, adds language to allow agencies of cities, towns and counties to jointly create a transportation authority.

-HB 3127 by Rep. Joe Dorman, requires increment and incentive district reports to be filed with the Oklahoma Tax Commission and the Department of Commerce.

-HB 3236 by Rep. Mike Jackson, allows improvement districts to be used to fund the acquisition, construction, installation or maintenance of capital improvments with an estimated useful life of five or more years.

-HB 3348 by Rep. Terry Harrison, prohibits any entity in the executive department of the state to use revenues to advertise or display the identity of the agency through any media unless the content of the advertisement includes some description of the functions, duties or mission of the entity.

-HB 2734 by Rep. Wade Rousselot, prohibits the Grand River Dam Authority from selling water from portions of the Grand River and its tributaries downstream from the southern edge of the Markham Ferry Dam on Lake Hudson.

-HB 2716 by Rep. Jerry McPeak, directs the Attorney General to establish an “Unconstitutional Interstate Taxation Prevention Unit” for the purpose of preventing any state or its political subdivisions from enforcing any income, sales, use, excise, gross receipts, franchise or other state or local tax in a manner inconsistent with the Due Process Clause or the Commerce Clause of the U.S. Constitution.

-HB 2577 by Rep. Dale DeWitt, modifies the definition of “basic industry” under the Oklahoma Quality Jobs Program Act to include alternative energy structure construction, solar reflective coating application and solar heating equipment installation.

-HB 2935 by Rep. Todd Russ, directs a county assessor to change the assessment role based on any real estate conveyed between Oct. 1 and Dec. 31 each year.

-HB 3165 by Rep. Mike Shelton, allows any district or municipal court to establish a youth gang court pilot program.

-HB 3113 by Rep. Wes Hilliard, delays from the 2011-2012 school year to the 2013-2014 school year the date by which every school district must offer a full six-hour day of kindergarten free of tuition.

-SB 1287 by Sen. Sean Burrage, requires a petition or application filed in accordance to probate procedures to be accompanied by acknowledged, written consents of personal representatives of any deceased heir, devisee or legatee.

-SB 1678 by Sen. David Myers, requires the Department of Environmental Quality to mutually recognize environmental laboratory accreditations issued by the NELAC Institute’s primary National Environmental Laboratory Accreditation Program accreditation bodies without duplicative actions to determine the lab’s conformity to certain standards.

-SB 1679 by Sen. Clark Jolley, clarifies language regarding the Commission for Human Services’ ability to suspend or revoke a child care facility’s license if it fails to obtain liability insurance.

-SB 1762 by Sen. Debbe Leftwich, prohibits a person from owning or operating a hired bus or limousine service licensed as a motor carrier of persons and property under the Motor Carrier Act of 1995 to knowingly transport a minor or minors who are in possession of or consuming alcoholic beverages, including low point beer.

-SB 1779 by Sen. Sean Burrage, requires applicants for issuance or renewal of a driver license to be given the option to provide an emergency contact person.

-HB 2602 by Rep. Dennis Johnson, modifies language related to the calculation of part-time reserve officers in municipalities, removing language establishing different calculations dependent on population.

-HB 2171 by Rep. Mark McCullough, establishes the Oklahoma Discretionary and Special Needs Trust Act.

-HB 2729 by Rep. Wade Rousselot, states that use of chemical agents and electroshock weapons in secure facilities operated by or through contract with the Office of Juvenile Affairs shall be minimal and shall be prohibited except as specifically provided for in the rules of the Office of Juvenile Affairs.

-HB 2278 by Rep. Larry Glenn, modifies language related to the crime of home repair fraud to include when an individual represents that he/she is licensed, insured or bonded when entering into a home repair transaction and fails to provide in writing a detailed description of any and all licenses held by the person and all employees as well as any bonding coverage and insurance.

-HB 2316 by Rep. Glen Bud Smithson, adds definitions of “spoofing calling card” and “spoofing services” under the Anti-Caller ID Spoofing Act.

-HB 2655 by Rep. Daniel Sullivan, repeals language allowing a county employee fully vested with a county retirement system to receive up to four years of credit for time served as an elected city or state official.

-HB 2779 by Rep. Pat Ownbey, modifies qualifications for a deputy banking commissioner.

Glenn Coffee, allows charter schools to be sponsored by federally recognized Indian tribes and the governing bodies of cities with populations of more than 300,000 when the charter school is located in a school district that has an average daily membership of 5,000 or more and which all of part of the district is located within the boundaries of the city.

-SB 1753 by Sen. Debbe Leftwich, includes date of birth in the list of personal information to be kept confidential for those employed by public bodies.

-SB 2213 by Sen. Clark Jolley, seeks approval from the U.S. Department of Education to amend the state accountability plan and replace the criterion-referenced tests with a formative assessment system.

-SB 1962 by Sen. Clark Jolley, amends language regarding governing bodies of municipalities.

-SB 1601 by Sen. Sean Burrage, prohibits the expungement of records of investigations pursuant to the Protective Services for Vulnerable Adults Act, except by court order.

-SB 2096 by Sen. Patrick Anderson, mandates that after pursuing all collections methods of debts, the debt is to be considered uncollectable.

• The Senate on Wednesday congratulated Rumble the Bison, mascot of the Oklahoma City Thunder, on his first birthday with the franchise. Rumble was honored by his peers in 2009 as the National Basketball Association’s Mascot of the Year.

• The Board of Equalization took action on Tuesday, setting the level of the current fiscal year’s budget shortfall at $668.6 million. The Board also told lawmakers they would have $1.2 billion less to appropriate for fiscal year 2011 than was originally appropriated for the current fiscal year.
